New Labour Hire Licence Laws

Labour hire licencing scheme

Whether you’re a host employer or an employee, make sure you’re aware of the new rules.

To operate legally in Victoria from 30 October 2019, Labour Hire providers must obtain or have applied for a Labour Hire Licence under the LHL Act 2018.

The licensing system imposes obligations on Victorian businesses who supply workers that work in, or deliver services to other businesses.

To obtain a licence, providers are required to pass a fit and proper person test and show compliance with workplace laws and labour hire laws and they must report annually on activities.

What does this mean for labour hire workers?

The objective of the new regulation is to protect labour hire workers from being exploited, regulate labour hire providers and improve the transparency and integrity of the labour hire industry in Victoria.

What if a labour hire provider does not have a licence?

Labour hire providers have until the 29th of October 2019 to apply for a licence. Providers who don’t have a licence will be prohibited from using labour hire services from 30th of October 2019.

Hosts who enter into an arrangement with an unlicensed labour hire provider after the 29th of October 2019 will face substantial fines ranging from $120,000 to $500,000.
